By using Eatolist you accept these terms. Please read them in full, especially section 3 on non-refundable booking fees.
1. What Eatolist is
- Eatolist is a platform for discovering restaurants through short clips, and an intermediary for booking discount deals.
- We are not a restaurant and do not sell food. Food quality, service, cleanliness, and honouring the deal are the responsibility of each shop.
2. You pay in two parts
- Booking fee — paid to Eatolist in the app. It covers the platform's service fee and the creator's share.
- The rest of the food cost — paid directly to the shop at the shop. This money does not pass through Eatolist.
- Both amounts are shown clearly before you confirm every booking.
3. Cancellations and booking fee refunds
- You can cancel yourself within 24 hours of booking from the wallet in the app. We refund the full booking fee within 3 days, to the payment method you used.
- Self-cancellation is limited to 3 times in 30 days, so nobody can hold limited deals and cancel repeatedly while others miss out.
- After 24 hours you cannot cancel and the booking fee is not refunded. The same applies if you don't use the deal in time — it expires and you are treated as having given it up.
- The booking fee is what you pay to hold the spot and the price for you; the shop has already given up the chance to sell that seat.
- If the shop doesn't do what it advertised — it is closed, cancels the deal itself, or won't honour the conditions shown in the deal — that is the shop's own responsibility. Shops set their own prices and conditions and accept the Merchant Terms when creating a deal. Eatolist does not refund the booking fee in this case.
- You can always report it to us using the contact details in section 10. We review every report, and can suspend or close shops that do this repeatedly under the Merchant Terms.
4. Reviews and ratings
- Reviews and ratings are each user's own opinion, not the opinion or endorsement of Eatolist.
- We accept reviews only from people who actually booked and used a deal, or creators with a clip of that shop, to reduce fake reviews — but we do not verify the accuracy of every statement.
- We remove reviews that break the rules in section 5 once reported and reviewed, but we are not liable for damage caused by users' opinions.
- Shops that believe a review is unfair can report it, and we review it through the same process.
5. Content you may not post
- Illegal or obscene content, or content about gambling, drugs or weapons.
- Defamation, false accusations, or baseless allegations against shops or other people.
- Other people's personal data posted without permission, such as phone numbers, addresses, or faces of people who did not consent.
- Content that infringes others' copyright, including background music and clips you did not film yourself.
- Fake reviews, rating manipulation, or undisclosed paid reviews.
- Harassment, threats, or hate speech.
5/1. Copyright, music and takedown requests
- You must own, or have permission for, everything you post, including music and sound playing in a clip. Most popular music is copyrighted. If a clip has music you don't have rights to, turn on "Mute original sound" when posting.
- Advertising a clip is commercial use. Whoever runs the ad must confirm they have commercial rights to the clip's sound and music, and is responsible for that confirmation.
- Copyright owners or their authorised agents can ask us to remove content through the steps on our "Copyright notices" page (eatolist.app/en/copyright). Once we receive a complete notice we promptly remove or disable access to the content and tell the person who posted it. Posters who believe content was removed by mistake can dispute it through the same page.
- Repeat infringers: an account with 3 posts removed for copyright infringement can no longer post new content. Bookings and income earned in good faith are still handled under section 7.
6. Creator share
- If someone books a deal through your clip, you earn a share of that booking fee. The share rate is set by the shop and shown to you before you film.
- You can book through your own clip, but you won't earn a share — the system records which clip the booking came from as usual, but the share is zero.
- Earnings become available to withdraw after the customer uses the deal and the review period has passed.
- Bookings that are cancelled, refunded, or found to be fraudulent do not count as earnings, and if already paid we deduct them from your next payout.
- Content removed for breaking section 5 earns no share from bookings that came from it.
7. Suspension and account closure
- We may suspend or close an account if we find repeated posting of prohibited content, review or view manipulation, fake accounts or impersonation, fraud involving bookings or shares, or use of the system that harms others.
- Before closing an account permanently we will give our reasons and a chance to respond, except where immediate suspension is needed to prevent harm or is required by law.
- Earnings made in good faith before suspension remain yours and can be withdrawn as usual. Earnings from fraud will be forfeited.
- Deals you have already paid for and that haven't expired can still be used.
8. Our liability
- We are liable for damage caused directly by our own fault, up to the booking fee you paid us for the booking in question.
- We are not liable for food quality, illness from eating, a shop's service, or disputes between you and a shop.
- This limitation does not take away rights you have under consumer protection law.
9. Changes to these terms
- We give at least 30 days' notice, through in-app notifications, before changes that significantly affect your rights.
- If you don't accept the new terms, you can stop using the service and request account deletion.
10. Governing law
- These terms are governed by Thai law, and Thai courts have jurisdiction over disputes.
